I'm not sure I am. Any fault that will fail an MOT will be enough to result in grief/fine/points

Take failing and emission test for example. Nobody gives a sh*t and a police man would never have known previously. But now they have that information immediately available. They almost certainly wouldn't be able to verify that at the roadside. Ok copper and they'll leave you to it. Get a jobsworth and your car is going on a lowloader.

I think my point was clear. What are the circumstances you'd drive away from a failed test?

 

Would you if you'd failed an emission test?

 

How about brake failure?

The point you are making is that one is a safety issue and one isn't. That is clear, but both are equally illegal.

Actually, that's not true. If you still have a valid mot certificate but have failed a test you can drive the car to get it fixed or to another MOT as long as it meets minimum standards of roadworthiness.
