Really feel for you mate. People don't realise these cars aren't 'bump' friendly. I was involved in a shunt the other day in my company shed (a Pug) and all that happened was a little scrape on the number plate. If I'd been in the VX it would have been a new rear clam for sure.

Some people actually believe that 'bumpers' are meant to bumping. Fu*king idiots.

thanks for the hugs simon

CID eh? You got friends there? I'm surprised the detectives are bothered with something as 'menial' as a non stop damage only RTC... Nope... minor RTCs aren't on the list of performance targets blessed upon our forces by Labour so they get bugger all priority... I can't ever remember the Home Secretary ever banging on about how she's improving life for victims of non stops... The Gov set targets and we are forced to work to them... which is a shame as most bobbies hate these ****ers and would love to see them get some sort of justice...

stay strong Fab, this is a war of attrition, stick to your guns and you will win. Every minute they spend arguing about it is costing them money.

take a paint sample of the blue paint and tell the 'other' partys insurance you will get it tested to prove it was her car and THEY will end up paying that bill too  don't even think of giving up, fight for your rights :saw:

If this ends up in court and that looks like where it is heading at this rate, in civil court it is all about the balance of probabilities, you just need to amass as much evidence as you can including statements from the police, witnesses, damage reports, photos etc etc sounds like you would have a pretty strong case. I had a similar thing a few years ago, the other party was denying it and denying it. It went on for about a year but at the first sign of my insurance wanting to take them to court they caved in and admitted it all! not may people want to go in front of a judge and lie through their teeth over something so stupid but they will happily lie to their (and your) insurance company. So just hang in there and good luck!! :grouphug:

So who pays europa's bill if she and her insurance company don't admit liability?

I guess they assume that some way or other the case will conclude with a successful claim. Perhaps in the Ts & Cs there is something which says that the client has to pay if all else fails. And/or perhaps they only take on cases which they are sure they can 'win', because there is enough evidence (eg to succeed if it went to court). I had a witness, and questioned Mike at Europa to ask if there was any way this would end unsuccessfully for me, and he said that ultimately there wasn't - although it had the potential to be long-winded.

I suspect you're right about them only taking un-loseable cases, but equally, how likely was he to tell you "Well, yes, there's a chance it will end unsuccessfully and you'll be left owing us a shed load of cash".

I've always assumed this is in the t&c; if we can't claim on the other parties insurance, you'll be liable for the fees. I'd hate to be on the receiving end of the bill from a company like europa, esp if it includes 'like for like' hire car charges.
