They're trying to re-roll the dice.
Currently implementation of the rules doesn't work for them. The Renault engine is poorly integrated with the ERS, allowing more fuel or a different measure of fuel use will play into the hands of the Renault and Ferrari teams as the Mercedes fuel economy advantage will be eroded.

That's the argument RB's lawyers are using against the penalty standing. The hearing proper is about the penalty they received for breaking two rules in the sporting regs and the technical regs by exceeding permitted fuel flow rate as measured and not seeking or being given permission to change the monitoring methodology. That second breach is absolute, whether the sensor was reporting the correct or incorrect flow rates.
You're right though, a precedent was set about whether something was an opinion or not and Mercedes suffered a punishment as a result, despite having fuzzy permission to proceed. RB didn't even have the fuzziest of fuzzy permission to do what they did and any penalty should and will hopefully stand.

For the sake of opeing up the possibility of a strategy delta rather than just a manufacturer delta, i'd like them to win, however i'm sure most people with the exception of Bob want to see Red Bull struggle.
(this has got nothing to do with the approach Red Bull has taken or the focus of this case, it's purely from a sport point of view)

But they won't, and everyone can see that. I think Todt can see that.
It would also leave a pretty tasty looking team for potential owners. Honda coming back fully? What about rumors that VW would come in?

So, have they gained anything, any differentiation of how they should be measuring fuel?

Frosty relationship with FIA.
Was a lose lose situation for them.
