Ken, he's not 'within his rights', it's his obligation to return them.  Perhaps he could have spoken with you, but his actions are correct.

You either seek permission to cut and dispose or if no one is there to ask, then you have to give them back.

For many years I was trimming some foliage growing over our wall and I'd just put it back over. No issues.

I'd delay my move & start doing immature vandalism from the other neighbours or nick his gate, steal his plants kinda thing, just for a laugh mind. Then when you move in, he might start talking to you about all the strange goings on? Just make sure he ain't got CCTV, we'd all have a giggle at you expense if you was caught like the 'cat woman'?😈

I'd nip around and try and sort it out, nothing worse than a neighbour feud, it'll only end in tears and un wanted stress for you both.... Or move to a remote area with no neighbours
