Was the sale advertised on ebay "subject to satisfactory RAC inspection" or similar?

If you're thinking of bidding on a car on ebay, you should look at it, test drive, kick tyres, arrange RAC inspection, etc before placing a bid.

If you've won the bidding, you've entered into a contract to buy the car. Not to possibly, perhaps, maybe discuss buying it.

Ding Ding Ding

Na thats crap!, if the car is dodgy walk away!!

On Ebay if you are the winner then thats it you have entered into a contract.

If you did it to me I would sue you..simple as that and I would win

So sue me thumbsup

I can guarantee you wont win ;)

It is so easy to tell people what to do when its not your pocket on the line.

i hate the idea that i've inconvienced the guy but i've already spent almost £100 of my own money doing HPI checks and everything... now the twat won't even let me get a check done... you have to admit it stinks of dodginess.

as for negative feedback..... i think it'll be mutual.

As for him trying to make me buy it... i'll buy it when it's had it's checkup, as it's only a panel repair as he advertised then he's got nothing to worry about.

Also interesting how you're so sure you could get out of a legally binding contract jaseyboy ?

Because I know a good legal person :)

And if the other person knows a better one?

I agree that you should make sure it has been repaired as he stated.

bottom line.....

After that phone call it is abundantly clear the car is NOT as advertised. There is no reason in the world not to let me get it checked... it's not delaying the payment... still 7 days...

Bearing in mind i still intend to buy it and the checkup would have to come back with summit pretty scary (twisted chassis..not cat d) for me to pull out....
can anybody name one reason NOT to allow me to get it checked???

You have got to look at it from the sellers point of view. He has put it on eBay, at a low price in order to sell it. The rules on eBay are fairly straight forward. You have won an auction. You didnt win the right to optionally buy the car. You are therefore obliged to buy the item you said you were going to buy. If you dont as has been said earlier you will rightly get negative feedback. I personally wouldnt have bought a car I havent seen. But they are the rules. This guy probably thinks he has sold the car and then you come along asking for an inspection. That can only mean one thing to him, maybe you arent going to buy the car after all, hence him getting shirty. Now if you get bad vibes about this car from what you have said, dont buy it and get the bad feedback. But IMO it is you that is at fault not him you shouldnt bid on something that you are not prepared to hand over the cash and take away. Obviously it should be as described and you are entitled to confirm that. But again as others have said these things should have been agreed before you placed your bid NOT after you have won it.

If your getting it checked to see that the Cat D repair has been completed satisfactory - then thats OK. thumbsup If your getting it checked just to find any old fault/things needing attention not connected to the damage just to pull out/negotiate then thumbsdown EDIT - This should have been done before the auction.

No disrespect VX_beastie......but i've been burned selling things on eBay before and I can see it from both sides. Lets say the seller is tottally legit and you beat the other bidder by £10. You are now making noises about getting inspections etc which will make him think he isn't goign to get his money fast or you are going to drop the offer in some way. From his point of view he is now thinking "if the other guy had bought it I'd have the money in the bank now" Just a thought, no offence meant. Hopefully all will be well. chinky chinky P.s JaseyBoy - Legally binding means you are legally bound to pay if it is as advertised. I thnik the Seans lawyer could be a toddler and still win ;)

i understand what you're all saying... and yes i'm obliged to buy... and i WANT to buy. The check is purely to confirm it is AS advertised. If something else pops up unrelated then no problems i'll still buy it.. i EXPECT to put a grand or two into it... i'm not looking for excuses.. it is after all an insurance write off.... i've sent him a text saying i still want to buy and am not trying to catch him out.. i just want to make sure it's got nothing serious that he should've mentioned on the advert... I do agree with what you're saying about buying though... Form my point of view though he's selling a box of choclates, i've said i'll pick them upon Wednesday but my mate's coming to have a look in the box to make sure all the choclates are there and he's refusing to let me see i nthe box til i've had the money.... that's the way i see it. :(

i know.. why's it done that

it's the handbags isn't it? :D

p.s. just emailed seller saying i hope we can go ahead with this.. still want to do check but want to reassure you i want to buy this car on Wednesday i simply want to check it's as u advertised.. you can't expect everybody to own a garage and know everything about cars like you do. Hope we can do this amicably, and no offense intended.

I'd stay well clear of it! 1 negative feedback on eBay . . . who cares, better than getting lumbered with a car you don't want. If he leave bad feedback then just contact eBay and explain the situation, they'll sort it for you.

P.S. it's back on ebay as an '02 model... it's not it's an '01 model. the reg plate even confirms it. He also hasn't mentioned the fact he's bought a set of VX wheels with scuffing and crap tyres.... so it's not just cosmetic change is it.. he changed the wheels... i think i'm just being anal now  :drink:

From the ebay motors buying tips:

5. Ask the seller about taking a test drive or inspecting the vehicle before the auction ends, and also how and when they want their buyer to collect the vehicle.
..
9. Remember, a bid is a legally binding offer to buy a vehicle at whatever price the auction reaches, up to your maximum bid amount. If you are the winning bidder, you are legally obliged to pay and non-paying may cause the seller to take legal action. For more information, read eBay's User Agreement.

Hope it works out.
